These Terms of Use ("Terms") govern your use of MEAL-4DAT, including the website, the mobile applications, and any related services (together, the "Service"), provided by 4DAT LLC ("4DAT", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service provides tools and content to help organizers plan meal events, invite guests, collect commitments, sell tickets, check guests in, and size supply orders. Features may change, be added, or be removed at any time. We may suspend or end the Service, or your access to it, at any time, with or without notice.
2. Informational content only
Guides, checklists, planners, and recommendations in the Service are general information. They are not professional, legal, health, safety, or financial advice and do not account for your specific situation. You are responsible for verifying information before acting on it and for complying with the laws, regulations, and safety requirements that apply to you.
3. Product recommendations and affiliate links
The Service links to products sold by third parties, including Amazon.com. As an Amazon Associate, MEAL-4DAT earns from qualifying purchases. We do not sell, ship, warrant, or support those products. Prices, availability, and product details are set by the seller, may change without notice, and may differ from what the Service describes. Any purchase is a transaction between you and the seller under the seller's terms. We do not receive or store your order or payment details.
4. Events and supplies
Planner quantities are estimates based on typical per-guest rates and a buffer you choose; actual needs vary. Organizers are responsible for their events, including food safety, permits, venue rules, accessibility, and the accuracy of ticketing information. Where the Service enables ticket sales or payments, the organizer is the merchant of record and payments are processed under the payment processor's terms.
5. Accounts and your content
Some features require sign-in through a third-party provider (for example Apple or Google) or an organizer access code. You are responsible for activity under your account and for keeping your credentials secure. You keep ownership of the content and data you enter. You grant us the limited right to store and process that content only to provide the Service to you. You are responsible for having the rights to anything you upload and for its accuracy.
6. Acceptable use
You agree not to: use the Service for any unlawful purpose; interfere with or disrupt the Service; attempt to access data that is not yours; reverse engineer the Service except where the law permits; scrape or bulk-copy the Service's content; or use the Service to harass, defraud, or harm others.
7. Payments and subscriptions
Paid features are purchased through the Apple App Store or Google Play under their terms. Subscriptions renew automatically until cancelled through the store, and refunds are governed by the store's policies. Attendee payments to organizers are processed by the payment processor named at checkout under its terms.
8. Privacy
Our Privacy Policy explains what we collect and how we use it. Where analytics are collected on the website they are aggregate and do not include your name, contact details, or precise location.
9. Intellectual property
The Service, including its software, design, text, and graphics, is owned by 4DAT LLC or its licensors and is protected by copyright and other laws. We grant you a personal, limited, non-transferable, revocable license to use the Service for its intended purpose. Product names and marks of third parties belong to their owners.
10. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CALCULATION, ESTIMATE, OR RECOMMENDATION WILL BE ACCURATE OR SUITABLE FOR YOUR NEEDS.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, 4DAT LLC AND ITS MEMBERS, OFFICERS, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, PROPERTY, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR TEN U.S. DOLLARS ($10). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
12. Indemnity
You agree to defend and hold harmless 4DAT LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your events, or your violation of these Terms or of any law or third-party right.
13. Third-party services
The Service relies on third-party services (app stores, sign-in providers, payment processors, hosting, and retailers). We are not responsible for their availability, content, or terms.
14. Changes to these Terms
We may update these Terms. The effective date at the top will change, and material changes will be noted on the site or in the app. Continued use after a change means you accept the new Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction, except that either party may seek relief in small-claims court where eligible. Any claim must be filed within one year after it arises.
16. General
If any part of these Terms is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and 4DAT LLC about the Service. You may not assign these Terms; we may assign them to a successor. Our failure to enforce a provision is not a waiver.
